The legal tug-of-war between the Assam Government and Congress leader Pawan Khera has reached the doorsteps of the Supreme Court. In a swift move on Sunday, the state government filed a petition challenging a recent decision by the Telangana High Court that shielded Khera from immediate arrest.

The apex court is expected to take up the matter later this week, marking the latest chapter in a high-profile dispute involving allegations of misinformation and political friction.


The controversy traces back to public statements made by Khera regarding Riniki Bhuyan Sarma, the wife of Assam Chief Minister Himanta Biswa Sarma. Khera alleged that she possessed multiple passports and undisclosed foreign assets—claims he suggested were missing from the Chief Minister’s election affidavits for the April 9 Assembly polls.

The fallout was immediate:

  • Legal Action: A case was registered at the Guwahati Crime Branch.
  • Charges: The FIR includes sections of the Bharatiya Nyaya Sanhita (BNS) concerning cheating and the dissemination of false statements.
  • Defense: Khera maintains that his concerns are a matter of public interest, while the Assam government views them as a deliberate attempt to defame and mislead.

The Telangana High Court’s Safety Net

Last Friday, April 10, the Telangana High Court stepped in to provide Khera with a temporary “breathing space.” Recognizing that his fear of arrest was “reasonable,” the court granted him a one-week transit anticipatory bail.

This window was intended to allow Khera enough time to travel to Assam and seek regular legal relief from a local court. However, the bail came with strict strings attached:

  • Financial Bond: A personal bond of Rs 1 lakh plus two sureties.
  • Travel Restrictions: He is barred from leaving the country without permission.
  • Conduct: The court explicitly ordered Khera to cooperate with investigators and exercise restraint when making public comments about the case.

Why the Assam Government is Appealing

By moving the Supreme Court, the Assam government is signaling its intent to pursue the matter aggressively. While the Telangana High Court did not comment on the actual “merits” or truth of Khera’s claims, the state government argues that the protection granted to him should be overturned.

As the legal teams prepare for the Supreme Court hearing, the case remains a focal point of the political landscape, highlighting the increasingly thin line between political rhetoric and legal liability.
